General Terms and Conditions of Sale (GTC)

1. Scope

These GTC apply to all orders placed on the online shop switzerland-1291.ch (the “Shop”), operated by EMVEE VENTURES LTD, 71-75 Shelton Street, Covent Garden, London WC2H 9JQ, United Kingdom — contact@switzerland-1291.ch (the “Seller”). By placing an order, the customer accepts these GTC in the version in force at the time of the order.

2. Products

Products are made to order (printing or embroidery produced on order). The visuals shown on the Shop are created using digital and artificial-intelligence design tools for illustration purposes; slight differences (shades, textures, rendering, print positioning) with the physical product delivered may occur and do not constitute a defect. GREAT SINCE 1291 is an independent brand; the products are neither official articles of the Swiss Confederation nor licensed products of any organisation.

3. Prices

Prices are in Swiss francs (CHF), including any applicable taxes. Delivery costs are shown separately before the order is confirmed. The Seller reserves the right to change its prices at any time; the applicable price is the one displayed at the time of the order.

4. Order and conclusion of the contract

The presentation of products on the Shop does not constitute a binding offer. The contract is concluded when the order confirmation is sent by email. The Seller may refuse an order in the event of an obvious pricing error, unavailability at the production partner or suspicion of abuse; any amounts already paid are then refunded in full.

5. Payment

Payment is made at the time of the order, using the methods offered at checkout (credit/debit cards and other displayed methods). The charge is made upon confirmation of the order.

6. Delivery

As the products are made to order, generally allow 10 to 15 working days between order and delivery in Switzerland (made to order then delivery; Europe: a few more working days). In periods of high demand these times may be extended. These times are indicative and do not constitute firm deadlines. If delivery proves impossible due to the customer (wrong address, uncollected parcel), reshipping costs may be charged.

7. No right of return (made-to-order products)

Swiss law does not provide a statutory right of withdrawal for online purchases. As our products are made to order (printing or embroidery produced specifically after the order), no return, exchange or refund for personal convenience (change of mind, wrong size or product choice) is accepted once the order is confirmed. The customer is invited to check their choice (model, size, colour) and the measurements provided before finalising their order. The statutory warranty for defects (art. 197 et seq. CO) remains fully applicable (see article 8).

8. Warranty

The statutory provisions on the warranty for defects in the item sold (art. 197 et seq. CO) apply. In the event of a defect, the customer reports the defect with a photo via the Contact page; the Seller, at its choice, replaces or refunds the defective item at no cost to the customer.

9. Liability

The Seller's liability is limited to direct and foreseeable damage, to the extent permitted by law. Liability for gross negligence or wilful misconduct and liability for personal injury are reserved.

10. Intellectual property

The contents of the Shop (texts, designs, images, brand) are the property of the Seller or used with permission. Any reproduction for commercial purposes is prohibited without prior written consent.

11. Data protection

The processing of personal data is described in the Shop's Privacy policy.

12. Applicable law and jurisdiction

Swiss law applies, excluding conflict-of-law rules and the Vienna Convention (CISG). The place of jurisdiction is the Seller's registered office, subject to the mandatory jurisdictions provided by law, in particular in favour of consumers.
